Filters don't seem to work when using "Merge" folder drop

I have set up a default filter to exclude certain files when transfering. This filter works fine when dragging-and-dropping a folder to a location where the folder doesn't exist. However, when I drop it in a location where the folder already exists, select "Merge" then "Copy and Replace" it copies all files, including the ones that should be excluded.

The filter only works in the Transfer Queue. Select "Use Automatic Rules" in the file exist/conflict dialog. This is by design.

"by design" since when?

I clearly remember that FileFilters worked in Merge and CopyAndReplace modes (wich use the transfer queue as well??).
After the last update this ceased to work and it nearly drove me nuts until I found this post ...

I don't understand why it has been changed that way?
Or am I getting something altogether wrong?
